1. Acceptance of Terms

By accessing or using WholeFiit, you confirm that you are at least 13 years of age, have the legal capacity to enter into these Terms, and agree to comply with them. If you do not agree, please do not use the App.

2. Description of Service

WholeFiit is a personal health and fitness tracking application that allows users to:

• Log and track workouts and physical activity
• Monitor calorie intake and expenditure
• Track body measurements and weight over time
• Log menstrual cycle and related health data
• Receive personalized fitness insights and push notification reminders
• Access premium features via subscription
• Earn referral credits by inviting friends and redeem them for digital rewards, subscription upgrades, or physical merchandise
• Receive optional SMS workout reminders (Core and Pro subscribers who provide a phone number)
• Browse and purchase WholeFiit merchandise via the in-app Store (fulfilled by Printful, payments processed by Stripe)

All personal health and fitness data entered into WholeFiit is stored locally on your device only. Divine 360 LLC does not have access to your health data.

3. Local Data Storage and Your Responsibility

Because WholeFiit stores your health and fitness data locally on your device, you are solely responsible for:

• Maintaining backups of your device and app data
• Ensuring your device is secured with appropriate access controls
• Understanding that uninstalling the App or resetting your device will permanently delete your WholeFiit health data
• Any data loss resulting from device failure, loss, theft, or damage

Divine 360 LLC is not liable for any loss of locally stored data under any circumstances.

4. User Accounts

To use WholeFiit, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your login credentials confidential
• Notify us immediately at privacy@wholefiit.com if you suspect unauthorized access
• Be responsible for all activity that occurs under your account

5. Subscriptions and Billing

5.1 Subscription Terms

• Subscriptions are billed on a recurring basis (monthly or annual, as selected)
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Payment is charged to your Apple ID or Google Play account upon confirmation of purchase

5.2 Cancellations and Refunds

• You may cancel your subscription at any time through your Apple App Store or Google Play account settings
• Cancellation takes effect at the end of the current billing period
• Refunds are governed by Apple App Store and Google Play refund policies

5.3 Downgrades

If you downgrade your subscription tier, your current tier's features remain active until the end of the current billing period. The downgrade takes effect at the start of the next billing cycle.

5.4 Price Changes

We may change subscription pricing with reasonable advance notice. Continued use of the App after a price change constitutes acceptance of the new price.

6. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract the source code of the App
• Use automated scripts or bots to access the App
• Interfere with or disrupt the App's servers or infrastructure
• Upload or transmit malicious code or harmful content
• Impersonate any person or entity
• Abuse the referral program through self-referral, fake accounts, or any fraudulent means

7. Health Disclaimer

WholeFiit is a personal tracking tool and is NOT a medical device or medical service. The App does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning any new fitness or nutrition program, especially if you have a pre-existing health condition. Divine 360 LLC is not liable for any injury, illness, or health outcome resulting from your use of the App.

8. Intellectual Property

All content, design, graphics, software, and trademarks within the WholeFiit App are the exclusive property of Divine 360 LLC or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

9. User Data

Any data you input into the App remains yours. Because health data is stored locally on your device, Divine 360 LLC does not claim any rights over it. For account data transmitted to our systems, you grant Divine 360 LLC a limited license to store and process it solely for the purpose of providing the App's services.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in fraudulent activity. Upon termination, your right to use the App ceases immediately. Locally stored health data on your device is unaffected by account termination.

11. Disclaimer of Warranties

WholeFiit is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, Divine 360 LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or personal injury, arising out of your use of or inability to use the App. Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Referral Program and Rewards

WholeFiit offers a referral program that allows users to earn credits by inviting others to sign up. Credits may be redeemed for digital rewards (such as routine unlocks, subscription upgrades, or extra AI workouts) or physical merchandise (such as t-shirts and hoodies). The following terms apply:

• Credits are awarded only after the referred user completes their first workout. Sign-up alone does not trigger a credit award
• Self-referral (using your own code to create a second account) is prohibited and will be rejected
• Credits reset to zero when redeemed. Routine unlocks earned through credits are permanent and are not revoked upon credit reset
• Physical merchandise rewards are fulfilled by Printful. Shipping times are estimated at 7–14 business days. Divine 360 LLC is not liable for delays caused by Printful or third-party carriers
• To claim merchandise, you must provide your name, email address, and shipping address. This information is used solely to fulfill the order and is deleted after shipment confirmation
• Divine 360 LLC reserves the right to modify or discontinue the referral program at any time with reasonable notice

14. SMS Workout Reminders

Core and Pro subscribers who provide a phone number may receive SMS workout reminder messages when they have been inactive for 3 or more days. By providing your phone number, you consent to receive these messages via Twilio. Message frequency varies based on your activity. Standard message and data rates may apply. You may opt out at any time by replying STOP to any message or by removing your phone number in the App settings. For help, reply HELP. WholeFiit does not use your phone number for any purpose other than sending workout reminders.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Divine 360 LLC is incorporated, without regard to its conflict of law provisions.

16. Changes to These Terms

We may update these Terms from time to time. Your continued use of WholeFiit after changes are posted constitutes your acceptance of the updated Terms.

17. Entire Agreement

These Terms constitute the entire agreement between you and Divine 360 LLC regarding your use of WholeFiit and supersede any prior agreements.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
